TERMS AND CONDITIONS

I. PRINCIPLES APPLICABLE TO ALL PATIENTS

1. Medical services can be accessed by Patients, as a rule, from Monday through Saturday between the hours of 8.00 – 20:00. PFI Dr. Tofan Bogdan may modify this schedule as it deems appropriate.
2. Acceptance of medical services can be made by telephone on 0768 602 943 or by e-mail contact@therapeutica.ro.
3. The transmission of notifications, invoices, correspondence with the patient by PFI Dr. Tofan Bogdan will be made to the contact details mentioned by the patient by phone or e-mail.
4. The sms or e-mail communications, without being limited to the requested appointments, information on the results of the investigations performed or any possible payment remainders recorded, information on the operational procedures / systems PFI Dr. Tofan Bogdan, which have an impact on the way of carrying out the medical activity, are not promotional, their purpose is to ensure the smooth running of medical services requested by patients.
5. In exceptional cases, the appointment may be postponed, when the doctor provides care in priority cases from the medical point of view or in cases that require increased medical attention / supervision. Also, for objective reasons, the doctor may have to cancel/reschedule an appointment, in which case the patient will be contacted to offer an alternative appointment.
6. PFI Dr. Tofan Bogdan will use all legal methods, including contracting specialized debt collection companies, lawyers, bailiffs for the recovery of the Patients’ debts.
7. Patients have the obligation to know and respect the applicable legal provisions, namely Law 95/2006, Law 46/2003 and related legislative acts, Patients cannot invoke in their defense the lack of knowledge of the law.
8. In accordance with the provisions of the Fiscal Code, we inform you that we issue tax invoices for medical services rendered, at the request of patients, on behalf of individuals and / or legal entities (companies / associations and foundations) / PFA, PFI. In order to issue an invoice in the name of a legal entity, it is necessary to sign in advance with that legal entity, a specific contract for the provision of medical services for the services provided to the patient, according to the contractual conditions previously agreed by it on the website.
9. Suspension of the provision of Medical Services is made in the following situations, without limitation: (i) The Patient has not paid the invoices issued, (ii) The Patient or the relatives are in a litigious situation with PFI Dr. Tofan Bogdan; by litigious will be understood litigation registered in court or any other complaint made by the Patient that could bring major damage to the doctor; (iii) In other cases expressly provided for in the contract signed by the Patients with PFI Dr. Tofan Bogdan or in the law.
10. In the case of investigations where express consent in the form of medical consent is required, the absence of the Patient’s express consent on the specific forms is equivalent to lack of consent, in which case the provision of the requested medical services will be stopped immediately.
11. Telemedicine is available exclusively to patients who have reached 18 years of age. In the case of underage patients, information regarding services, access conditions or scheduling of appointments can only be made by a parent or by a person exercising parental authority in relation to the patient in question.
12. The user declares and guarantees that he/she is at least 18 years of age, that the information provided in order to identify him/her as a patient refers to his/her own person and is true, accurate and complete.
13. Providing information that is not in conformity with reality, inaccurate or incomplete entitles the doctor to stop the conversation. Furthermore, in the case of suspected (attempted) fraud, the doctor reserves the right to take all measures available to him/her against the user in question, including the possibility of prosecution.
14. During the interaction with the physician, the patient will use a decent tone and language. Profanity, insulting or vulgar expressions, threats of any kind or any other acts against the physician or any other person of a nature to inspire fear or to offend the dignity and honor of the physician will not be tolerated, and in such cases, the physician will be entitled to cease the conversation. Also, if he/she deems it necessary, the doctor reserves the right to take all measures at his/her disposal against the user in question, including requesting his/her prosecution.
15. Telemedicine is a service of providing a medical consultation via electronic means of communication.
16. Consultations/Suggestions/Recommendations will be provided by Dr. Tofan Bogdan, ensuring the confidentiality of conversations. The patient is, in turn, responsible for ensuring the confidentiality of what is discussed on his/her own equipment.
17. The communication network and equipment through which PFI Dr. Tofan Bogdan Dr. Tofan Bogdan offers the service are secure.
18. Given the technological and legislative limitations at this time, accessing this service represents your declaration that you understand the limitations of the chat service with a doctor, as explained in this document.

II. ONLINE CONSULTATIONS

Online consultations are a telemedicine service, which allow doctor-patient interaction in an online environment, through electronic/telephonic means of communication.

The online consultation service is available as an alternative to consultations in the presence of the patient in the doctor’s office, is not intended to replace the specialized medical consultation and is limited in terms of diagnostic possibilities.

The medical information provided by doctors is given only on the basis of the symptoms you describe or the documents the patient provides.

It is the patient’s responsibility to provide as accurate or complete a description as possible of symptoms, general state of health, medications used or treatments indicated by other physicians and not fully taken, medical history and any possible external factors with which the patient has come into contact (e.g. persons with communicable diseases, travel, substances of any nature, etc.).

Given the technological and legislative limitations at this time, accessing this service is your declaration that you understand the limitations of the online consultation service as explained in this document.

In view of the level of confidentiality and security required for safe access to this type of service, online consultations are only accessible via telephone, e-mail, zoom application.

In order to access the service, a telephone and internet connection is required to interact with the doctor.

PFI Dr. Tofan Bogdan assumes no responsibility in case the online consultation cannot take place or is interrupted due to the patient’s equipment or internet connection, in which case the consultation will be performed at another date.

Consultations will be offered by the doctor with doctor-patient confidentiality. The patient is, in turn, responsible for ensuring confidentiality in the space from which he/she accesses the consultation.

The communication network, the equipment, through which PFI Dr. Tofan Bogdan offers online consultations are secure, and access by the doctor to the consultation session is done through strong unique credentials.

The software used is Zoom Platform.

Access to the application by patients will be in Visitor format, without the need to create an individual account. Data will be processed through the Zoom application and will transit its servers located in the European Union. The consultation session will not be recorded, and no image or voiceprint will be stored by PFI Dr. Tofan Bogdan as a result of the online consultation session.

When the patient contacts the doctor through Zoom, he/she should be aware that all personal data processed during the consultation will also be processed by Zoom, in accordance with the specific terms and conditions of the service through which the patient contacted us, which he/she accepted at the time of the appointment, as well as with the personal data processing policy provided by Zoom through its own channels and means. This includes the possibility of transfer of patients’ personal data by Zoom outside the territory of the European Economic Area, to jurisdictions that may not offer the same degree of protection as that provided by Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (GDPR).

PFI Dr. Tofan Bogdan is not in any way involved in the way Zoom processes patients’ personal data and disclaims any responsibility in relation to it.

As a user, the patient accesses Zoom through his or her Zoom account in full knowledge of the facts, and the processing of his or her personal data in this context is based on his or her validly expressed consent.

If the patient does not wish his or her data to be processed by Zoom, he or she may contact the doctor by telephone.

The recording of the consultation by the patient is prohibited.

Otherwise, the doctor will stop the recording at the time he/she is notified, reminding the patient of the prohibition.

At a possible rebooking, the patient will be denied access, without the possibility of a new appointment and the usual rules for the use of PFI Dr. Tofan Bogdan services will be applicable.

The medical information that the doctor will obtain or determine during the consultation will be noted in the patient’s medical report, just as in the case of a clinical consultation, in the office.

The medical report can be requested by the patient, just like any medical report of a regular consultation.

Given the technological and legislative limitations at this time, accessing this service represents the patient’s declaration that he/she understands the limitations of the online consultation service as explained in this document.

• Online consultations, without the physical presence of the patient in the office, are only suitable for certain medical specialties and have certain characteristics, as follows:
• Consultations may only be offered for conditions of at most medium severity, involving a relatively good general condition of the patient.
• Follow-ups may also be offered after previous visits to interpret the results of tests and possibly assess how the condition is recovering
• Consultations will not be able to involve a full clinical examination (no measurements of vital signs, no clinical data from palpation or auscultation).
• Depending on the physician’s findings, the consultations may conclude with simple recommendations with instructions to follow, or with recommendations for a specialized clinical consultation or investigations, and in some situations a reassessment in the virtual office may be necessary.
• The doctor will not be able to issue all types of prescriptions (e.g. prescriptions that require special prescription forms – “green prescriptions”, prescriptions for acute compensated conditions cannot be issued).
• The medical report of the consultation, including the recommendations made at the end, will be included in the patient’s medical file and can be requested by the patient.
• The patient is asked to take into account the recommendations made by the doctor.

The doctor declines any responsibility if the patient does not follow these recommendations. In cases where the recommendations made during the consultation do not improve the symptoms presented, the patient has a duty to seek a new opinion.

If symptoms worsen or if adverse reactions to the recommended medicines occur, the patient should call the emergency number 112/ go to a hospital emergency room. For the use of the online consultation service, all the rules for accessing the services of PFI Dr. Tofan Bogdan mentioned in the first chapters of this document apply, with the necessary modifications.

The online consultation service is available as an alternative to in-office consultations.

Access to this service constitutes the patient’s consent to the processing of his/her voice and image under the conditions set out above, as well as acceptance of all terms and conditions included in this section.
